Can a debt become time-barred?

The limitation of debt does not mean the simple removal of the obligation after a few years. The type of claim and its date are important maturity and subsequent actions of the parties. We explain the basic terms, the specific situation of the consumer and why letters from the court or bailiff should not be left unanswered.
What does the limitation of a claim mean?
The limitation period limits the possibility of effectively pursuing a specific claim after the time provided for in the regulations. It is not the same as repayment, write-off liabilities or automatic deletion of all debt data. So first you need to determine what creditor demands and on what basis.
In cases against consumers, special protection applies: after the expiry of the deadline, as a rule, you cannot demand satisfaction of a time-barred claim. However, the Civil Code provides for the possibility of the court exceptionally not taking into account the limitation period for reasons of equity. Therefore, the age of the contract itself does not allow the outcome of a particular dispute to be predetermined.
Statute of Limitations - There is no single five-year rule

In accordance with the general principles of the Civil Code, the deadline is six years, and for periodic claims and claims related to business activity, three years, unless a specific provision provides otherwise. The end of the period generally falls on the last day of the calendar year; this rule does not apply to periods shorter than two years. Claims of a bank or lending company related to the financing granted are usually assessed in the context of business activity.
These rules should not be automatically transferred to taxes, ZUS contributions or any type of mandate. Different rules, different starting times and additional exceptions may apply in such cases. Online list of numbers only, without indication of type receivables, often leads to the erroneous conclusion that all old liabilities can be treated equally.
From what day does time count?
The starting point is basically the maturity of the claim, i.e. the moment from which the creditor may demand payment. This doesn't have to be the day you sign the contract or receive the money. In the case of an obligation repaid in installments, you need to check the dates of individual payments and the possible consequences of terminating the contract.
For example, a contract concluded a few years ago could provide for repayment spread over a longer period. Merely comparing the date of its signing with today's calendar is not enough. You need a schedule, payment information and documents showing whether the remaining obligation has become due in advance. Only on this basis can the chronology of the case be established.
What can change the calculations?

The course of the deadline may be affected by events provided for in the Act, including certain court actions or acceptance of the claim. It is necessary to distinguish between the interruption of the period, after which the deadline runs again, and its suspension. Not every message from a debt collection company has this effect. The sale itself receivables also does not automatically mean that the age of the debt is counted from the beginning.
Before signing a settlement, balance confirmation or debt acknowledgment statement, check the content of the document and its consequences. The context of the payments made may also be important. If you question the obligation or consider it to be time-barred, it is worth first organizing the documents and obtaining advice on the specific facts.
Expired debt from a bailiff - what should you check?
Enforcement requires a separate analysis of documents. A claim that has not yet been brought before a court is assessed differently from a receivable recognized by a final judgment. For claims covered by such a judgment, the Civil Code generally provides for a period of six years, and for periodic benefits due in the future, three years. Subsequent actions in the case are also important.
Read the received notification together with the instructions. Determine the court, reference number, creditor and basis for enforcement. Depending on the stage and cause of the dispute, different remedies may be appropriate; a simple phone call to the office does not replace the letter required by the procedure. Also, do not assume that every statute of limitations claim will be resolved by the bailiff in the same way.
How to prepare documents for debt verification?

- Collect the contract, schedule and any annexes
- Find confirmation of payments, settlements and termination of the contract
- Organize court correspondence and documents related to enforcement
- Separate the principal amount, interest and other costs indicated in the request
- Record the delivery dates of new letters and deadlines resulting from instructions
Don't pay just because the notice looks official, but also don't ignore it just because it concerns an old contract. Verify the documents and request first. People who cannot cover the costs of paid advice can check the conditions for using free legal aid. When it comes to the statute of limitations, the exact chronology is much more important than general information about how old the debt is.
