What is a reverse mortgage?

Reverse mortgage loan is a method of financing based on the value of the property, regulated by the Act of October 23, 2014. It should not be equated with life annuity offered in exchange for the transfer of ownership of the apartment. We explain the basic differences, settlement rules and issues important for the owner and his family.
What is a reverse mortgage loan?

In this model, the institution authorized to grant a reverse mortgage loan pays out the funds and their return is secured by real estate or a specific right to it. The Act provides for a one-off payment or in installments. The borrower retains ownership; just signing the contract does not mean immediately handing over the apartment to the bank.
It is necessary to distinguish the existence of regulations from the availability of a specific product. The adoption of the act does not mean that every bank has such an offer in its price list. Before comparing amounts, confirm exactly what type of contract a given institution offers and on what basis it operates. The name "inverted mortgage” used in advertising is not sufficient to establish rights and obligations.
Loan amount and property value

The valuation of the apartment or house is important for the amount of financing, but you should not expect payment of the full market value. Must be included in the settlement interest and other costs and the period of use of the funds. Before accepting the offer, ask to see how the amount was calculated and the payout terms, rather than evaluating the offer solely by the highest installment presented.
It is worth distinguishing between the value of the property, the amount actually received and the total settlement obligation. These three quantities are not equal. If the money is to be paid in parts, determine the period over which it will be paid and what happens after the entire agreed amount is used up. Loan installments do not have to mean a lifetime stream of money.
When comparing with other solutions, also prepare a scenario of longer use of funds and higher costs of maintaining the premises. Consider whether the money you receive is intended to finance recurring expenses or a one-time goal. This allows you to assess not only the amount of the first payment, but also what the budget will look like after the end of the payments provided for in the contract.
Who is this solution for and what are the remaining responsibilities?
Such financing is sometimes considered by seniors who own real estate and are looking for additional funds. However, on this basis, the law should not assign a single minimum age to the customer. The requirements of a specific offer must be checked in its documents. The legal title, co-ownership and the situation of the people living in the premises are also important.
A different loan structure does not eliminate the costs associated with the property itself. Before concluding the contract, determine who will bear the expenses insurance, taxes, administrative fees and necessary repairs, as well as what obligations apply to maintaining the premises in an appropriate condition. The extra money shouldn't overshadow these items in your monthly budget.
Also talk to people whose housing situation is related to the property. If the property is shared, do not base your decision on the assumption that one person's signature solves all issues. Present the ownership documents and ask for an explanation of the consequences for the co-owner, spouse and other household members. Answers should refer to the specific contract.
What happens after the borrower dies?

The Act provides for the possibility of repayment of the total amount payable by the heirs within 12 months from the death of the borrower, and, in the case of an appropriate joint agreement, from the death of the last borrower. This allows you to keep the property after settling the liability. Failure to make such repayment will result in further settlement according to statutory rules; you should not assume that the premises will remain in the family without any encumbrances.
Preparing the family for such a situation is of practical importance. It is worth indicating where the contract, payment documents and contact details of the institution are located. Heirs should know not only the deadline, but also how to obtain the current balance and the settlement procedure. The exact consequences depend on the documents and the estate situation.
Reverse loan and annuity
In the case of a life annuity in exchange for real estate, the main difference concerns the transfer of ownership during life and securing the right to continue living. In a reverse loan, the owner retains title to the property for the duration of the contract. The rules for payments, settlements after death and the situation of heirs also differ. So don't compare these products like two names of an identical service.
Before signing anything, ask when the ownership changes, on what basis you can continue to live in the premises and what will happen in the event of problems with the institution paying the funds. It is a good idea to analyze the documents regardless of the person selling the product. The decision concerns housing and family rights for many years, so it should not depend solely on the promised monthly amount.
