Jak uniknąć problemów po przekroczeniu terminu spłaty

In every person's life it may happen that he crosses repayment date financial obligation i loan company will take certain actions to recover the funds. The worst solution in such a situation is to avoid any contact with the loan company and not to respond to requests for payment, i.e. reminders. If such a situation occurs, you should change your behavior as soon as possible and start negotiations with a loan or debt collection company.

Don't avoid responsibility

When you are unable to fulfill the contract concluded with the loan company, the worst solution is to avoid liability. Many debtors wrongly believe that if they avoid contact with the lender, over time he will refrain from collecting the funds due. However, they are wrong. Lender not only will it not be forgiven, but the debt will also increase. The fact is that not everyone does prompt nor contact by a debt collector means an allowable additional fee; the cost requires a correct basis. Depending on the lender and the concluded contract, these fees may even significantly increase our debt.

Dialogue with the lender

The best solution in such a situation is to talk to a loan company or debt collector. You should stop hiding from them. Proposing to solve the problem is welcomed by lenders who then see that the client is interested in repaying the loan and the delay is not the result of bad will, but only of certain unforeseen situations. First of all, the reason for the financial arrears should be explained. You should also present your financial situation and indicate current problems. It is obvious that both the lender and the debt collector are human and they realize that such a situation can happen to anyone, and they, like debtor, are interested in ending the case and recovering funds. Certainly, conversations with both the debt collector and the loan company can be unpleasant and difficult, but only an attempt to settle the dispute amicably can help the client avoid further problems. It should always be borne in mind that the most important thing is the debtor's initiative and willingness to repay the debt. Of course neither creditor neither the loan company will believe the debtor's assurances and it is necessary to show that the debtor is actually interested in repaying the loan. Therefore, a very good solution is to pay off at least a small part of the debt.

Negotiations regarding repayment terms

The behavior of the debtor is very important when negotiating with a loan company. He should show remorse. You should also avoid any lies, as they may result in the loan company referring the case to the bailiff, who may deprive the debtor of electronics and household appliances, as well as many other valuable items. You should consider the real possibilities of repaying the financial obligation. Suggest spreading the debt repayment in installments, e.g. over several weeks or months. In some cases, you can try to apply for a reduced extension of the debt repayment amount, write-off penalty interest and debt collection fees.

Contact is simply important. Loan companies are not willing to transfer debts to debt collection institutions for a long time, as it involves additional costs that cannot always be recovered from the debtor. Therefore, they are very willing to accept various debt repayment proposals that will be satisfactory for both parties. This is why you should not avoid contact with the lender, because you can always find a joint solution to the problem. Failure to reach an agreement will, over time, exhaust the lender's patience, which will transfer the debt to a debt collection institution and, if ineffective, take it to court.

Confirm the agreed terms

After the conversation, ask to confirm the conditions: new date, installment amount, method of calculating costs and consequences of delay. Do not consider merely requesting a postponement as consent to amend the contract. Also keep an eye on the deadlines in court documents, regardless of the ongoing negotiations.
